Pre-Contract Management

Andrew offers a range of pre-contract review, drafting and negotiation services tailored to the specific needs of his clients who may wish to outsource or supplement their existing teams in the provision of these deliverables. Utilising his dual experience as both a degree qualified quantity surveyor with hand-on project manager experience, trained in claims management, with a postgraduate diploma in construction law, adjudication and arbitration, Andrew leverages these attributes to serve his client’s needs during the pre-contract stage. His legal training is founded on the common laws of Scotland and England & Wales whilst including a study of comparative law of the civil laws of Italy and other jurisdictions within Europe.

In an industry where the standard forms of contract are often amended, and subcontracts terms and conditions often gleefully explore the limits of ‘freedom to contract’, an experienced set of eyes reviewing your contract documents and assisting your negotiation could be invaluable to your company.

An investment in the diligent review and clear drafting of contracts will help both parties understand their respective roles, responsibilities and obligations. This becomes particularly relevant when the Client/Employer, Contractor and Subcontractors are international parties, operating in potentially unfamiliar legal jurisdictions. Ultimately, this serves the good of the project by minimising surprises and dispelling issues before they become disputed.

Andrew Davidson drafts in plain English and is adept with the use of FIDIC, JCT, SBCC, NEC contracts and bespoke contracts amendments to these standard forms. His previous sector experience includes data centres, medical, education, civil engineering, construction, roads & tunnels. As a resident of Italy with British citizenship, Andrew has freedom to travel throughout the Schengen area and the United Kingdom without the need for a visa.
